At a press conference President Trump claimed the Biden administration’s use of the autopen is “one of the great scandals of all time.” He suggested that many executive orders, including controversial ones involving immigration, transgender rights, and clemency, may not have been signed or even authorized by Biden himself.
“Who signed these orders, proclamations, and all of the different things that he signed that set our country so far back?” Trump asked, questioning whether the president was truly in charge.
In a follow-up post on his social media platform Truth Social, Trump doubled down:
“Other than the Rigged Presidential Election of 2020, the Biggest Scandal in American History is the ‘AUTOPEN!’ Whoever used it was usurping the power of the Presidency… They did things that a Joe Biden, of sound mind, would have never done.”
The implication: that aides — not Biden — may have used the autopen to enact policy, thereby bypassing democratic accountability.
A Scandal or Political Strategy?
These claims have prompted an investigation by the House Oversight Committee, seeking to determine who had access to the autopen and whether it was used without Biden’s full awareness. Even the Senate has reportedly launched a parallel inquiry.
But Trump’s argument is less about the legality and more about the legitimacy. If Biden’s most controversial executive orders — from opening borders to allowing transgender athletes in women’s sports — were signed without his explicit knowledge, Trump and his allies argue it reflects a dangerous erosion of presidential responsibility, and those executive orders could be revisited.
